You agree to be bound by such modified, altered, and updated Terms if You access or use this Site after BFR has posted notice of such modifications, alterations or updates. This Site will also permit You to link to many other Sites that may or may not be affiliated with this Site and/or with BFR. Your access to and use of such linked Sites through links provided on this Site is governed by the terms of use and policies of those sites, not this Site.

2. Based upon the User’s agreement to adhere to these Terms, and/or use of this web site, BonaFide Realty grants and conveys to the User, during usage of the web site, during the term of any free trial membership, during the term of any paid membership and/or at any time following the date the User becomes a registered user, a non-exclusive, non-transferable license to use the data, information and services provided through the web site subject to the restrictions detailed below. 3. Orders are shipped from our warehouse within 72 hours. If you have any questions regarding our shipping proceedures, or tracking your order, please contact us.
   

4. Our exchange policy is very simple. We will only exchange an item or reimburse all costs on an item either for defects or for a alternative size in the same product. That is another reason we have chosen paypal as our merchant gateway. In case of reembursements, you will recieve your money in the same easy and efficient way you used to pay us. Either through paypal or through a bank money transfer.

   * We will only reimburse shipping expenses for defects in product. If an item is returned to be exchanged for an alternative size, client pays all shipping costs. If you are unsure about product sizes or composition, contact us.

   * All our merchandise goes through rigorous quality control inspections and tests. In the event that our product is found to be defective, it must be returned within 15 working days. Prior notice is mandatory.

5. By registering with/on the BFR Site, You acknowledge that:
   1. You are entering into a lawful consumer-broker relationship with the participant;
   2. All data obtained from this Site is for Your personal, non-commercial use;
   3. You have a bona fide interest in purchase, sale, or lease of real estate of the type offered through this Site;
   4. You will not copy, redistribute or retransmit any data or information provided; and
   5. You acknowledge the MLS's ownership of and the validity of the MLS's copyright in the MLS database.

6. BFR controls and operates this Site. All Content on this Site, including, but not limited to, text, photographs, images, illustrations, audio clips, and video clips, is protected by copyrights, trademarks, service marks, and/or other intellectual property rights (which are governed by United States and worldwide copyright laws and treaty provisions, privacy and publicity laws, and communication regulations and statutes). The Content is owned and controlled by BFR or its affiliates, or by third party content providers, merchants, sponsors and licensors (collectively the "Providers") that have licensed their content or the right to market their products and/or services to BFR. Content on this Site or any Site owned, operated, licensed or controlled by the Providers is solely for Your personal, non-commercial use. You agree to abide by all additional copyright notices, information, or restrictions contained in any Content. You may download Content contained on this Site, solely for Your personal, non-commercial use, consistent with these Terms, provided that You maintain all copyright and other notices contained in such Content.

   You may not copy, reproduce, republish, upload, post, transmit, distribute, and/or exploit the Content in any way for commercial use without the prior written consent of BFR or the Providers. Your modification of the Content or use of the Content on any other Site, or use of the Content for any purpose other than personal, non-commercial use, without the prior written consent of BFR or the Providers, violates the intellectual property rights and proprietary rights of the Content owners and is prohibited.

   You may not use on Your Site any registered or unregistered trademarks, service marks or copyrighted materials appearing on this Site, including but not limited to any logos or characters, without the express written consent of the owner of the mark or copyright. You may not frame, deep link, or otherwise incorporate into another Site any of the Content or other materials on this Site without BFR's express prior written consent.

   Violation of trademark and copyright laws may result in significant civil liability or criminal penalties under United States and/or worldwide copyright and trademark laws. You recognize that any reproduction or use of Content, except as authorized by these Terms, is considered intentional infringement.

7. Term Period of User Access: The term of User’s access is based upon User’s express agreement and adherence to these Terms and Conditions and to User’s fully paid subscription fees associated with members when applicable. All paid subscriptions shall be for the agreed upon term (e.g. monthly, quarterly, semi-annually or annually) and shall automatically renew for indefinite successive renewal terms for the same period as the initial term unless terminated by User or BonaFide Realty. However, if the User accepts a special introductory promotional offer for a subscription or a multi-month discounted subscription, then at the conclusion of the specific initial term of the special introductory promotional offer term or multi-month discounted subscription, the subscription shall automatically renew on and User agrees and authorizes BonaFide Realty to charge User’s credit card or bank account on a pre-paid basis for a month-to-month basis for indefinite successive month-to-month renewal terms at the then prevailing regular published monthly retail rate at time of renewal until terminated in accordance with the provisions of these Terms. User agrees that there is NO refund, offset or credit that will be given for any cancellation of a special introductory promotional offer subscription or a multi-month discounted subscription. If User registers for a free trial, User agrees to be rolled into a pre-paid month-to-month subscription at the end of the free trial period, if User does not cancel the free trial prior to the expiration. The User agrees and authorizes BonaFide Realty to process a charge to the User’s credit card or checking account provided by User during User’s registration or User information update process to prepay User’s subscription. The initial term begins at the end of the free trial period, unless the User cancels within the free trial period.

8. Termination: BonaFide Realty reserves the right to cancel services provided to any User at any time, in BonaFide Realty's sole discretion. The User may cancel the User’s usage or subscription at any time. All fees due to BonaFide Realty up to the end of the then current term billing cycle at time of termination shall remain payable to BonaFide Realty unless otherwise specifically provided to the User in a related specific promotional offer.

9. The User may terminate the subscription contract by one of five ways:
   1. Online using the PayPal web site, accessible to the User who has a PayPal account.
   2. By e-mailing a cancellation request to helpdesk@bonafiderealty.com at least five (5) days prior to the desired cancellation date.
   3. By telephoning a cancellation request to 866.296.4088 during business hours of 10am to 5pm EST Monday through Friday. User acknowledges and agrees to be charged or billed a $15 dollar service and processing fee for all cancellations processed via telephone.
   4. By faxing a cancellation request to 201.441.355 at least five (5) days prior to the desired cancellation date.
   5. By mailing a cancellation request at least ten (10) days prior to the desired cancellation date to BonaFide Realty, 102 E. Main St., Little Falls, NJ 07424.

10. PAYMENT OF CHARGES
    BonaFide Realty primarily charges a monthly subscription fee, but other term time periods are available. The subscription fee is calculated from the first day of the term (usually monthly, but can include three month, six month, yearly, etc.) that the User's paid subscription commences. The User agrees that if the User applies for the seven (7) day free trial subscription (where applicable) and does not cancel the trial subscription before the expiration of the seven (7) day free trial subscription, the User authorizes BonaFide Realty to convert the User's trial subscription into a regular monthly subscription or other term subscription for the term they selected effective on the seventh (7th) day, or 168 hours following the User's initiation of the seven (7) day trial subscription. The User authorizes BonaFide Realty to, and the User agrees that BonaFide Realty may, charge to the User's credit card, debit card or bank account, in advance, the User's regular subscription fee for each agreed upon term of the User's selected subscription term. The User authorizes BonaFide Realty to, and the User agrees that BonaFide Realty may, modify and/or change the term subscription fee charged to the User upon thirty (30) days notice to the User sent by e-mail. The term subscription fee, when paid, is non-refundable and accrues on the first day of each term and/or successive renewal term until canceled, regardless of whether or not the User accesses or makes any use of this web site or database. Notwithstanding the language in this paragraph, if the subscription resulted from a special introductory promotional offer, then the terms of that specific promotional offer shall control.
    1. On Time Payment: The User is required to pay all charges on time and agrees to submit an accompanying payment authorization in connection with these charges when requested by BonaFide Realty. Credit card transactions require an acceptable and currently working/continuously valid credit card number/account. BonaFide Realty may terminate or disable the User's participation in BonaFide Realty services if the User fails to pay fully and in a timely manner all amounts due to BonaFide Realty. If the User's credit card expires or is otherwise declined for payment, access to BonaFide Realty services and its web sites can be modified or suspended without notice to the User. If any User payment is more than thirty (30) calendar days past due, interest pro-rated daily, at the rate of 15 percent per annum on the outstanding balance, or the maximum allowable by law, whichever is less, shall accrue, and the entire amount of unpaid charges and/or any other outstanding balance (if any), plus this assessment, will become immediately due and payable. The User shall pay all costs of collection, including legal fees, incurred by BonaFide Realty. The User is responsible for any premium charges incurred in connection with the use of information, content, goods, products or services that are provided at an extra cost. All fees are quoted and payable in United States Dollars. The User is also responsible for paying all applicable taxes for information, content, goods, products or services and any other costs incurred in connection with the use of or access to BonaFide Realty and its web sites.
    2. Payment Methods: The User's complete billing address and telephone number must be provided to process payments. BonaFide Realty accepts major credit cards including Visa, MasterCard and American Express and may accept bank drafts, including personal checks, money orders, cashiers checks, and company checks. However, for non-credit card payment methods, BonaFide Realty does not offer a 7-day free trial and may not credit the applicable account until additional procedures are completed and after BonaFide Realty's bank certifies receipt of funds — typically ten (10) business days. BonaFide Realty may charge a twenty-dollar ($20.00) handling fee, or the maximum allowable by law, whichever is less, for each check returned unpaid for insufficient funds or any other reason.
    3. Account Discrepancies: A User may contact the BonaFide Realty Helpdesk by e-mail at helpdesk@bonafiderealty.com or telephone at 866.296.4088 concerning charges or other questions regarding the status of the User’s account. However, if the User's account questions are not satisfactorily resolved within fifteen (15) business days of User's calling or sending an e-mail, and in no event later than ninety (90) days after a questionable account billing or other discrepancy should have been or could have been reasonably discovered, the User must write to the Customer Service Department, BonaFide Realty, 1266 Hamilton Ave., Trenton, NJ 08629, delivered by United States mail or by fax to 201.441.355. Otherwise, any and all such User complaints are waived by User.

11. You warrant and represent to BFR that You will not use this Site for any purpose that is unlawful or prohibited by these Terms, including without limitation the posting or transmitting any threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material. If You violate any of these Terms, Your permission to use this Site immediately terminates without the necessity of any notice. BFR retains the right to deny access to anyone at its discretion for any reason, including for violation of these Terms.

    You are solely responsible for Your Information, and BFR acts as a passive conduit for Your online distribution and publication of Your Information. As used in these Terms, "Information" means any information or data that You submit to this Site and any information or data that is generated by this Site as a result of Your use of this Site.

    In the event that You are provided with User identification (collectively, " ID's"), confirmation numbers, and/or passwords (as applicable) in the use of this Site, You shall maintain such User ID's, confirmation numbers, and/or passwords in confidence and You agree not to distribute or disclose the same to third parties. It is Your responsibility to notify BFR to change or discontinue any of Your ID's, confirmation numbers, or passwords. It is also Your responsibility to immediately request discontinuation of an ID, confirmation number, or password upon Your knowledge or belief that such ID, confirmation number, and/or password is, or may be subject to, a breach of confidentiality. BFR may suspend or terminate Your service or access to this Site if a breach of these Terms has occurred.

    You agree to provide true, accurate, current and complete Information. If You provide any Information that is untrue, inaccurate, not current or incomplete (or BFR has reasonable grounds to suspect that such Information is untrue, inaccurate, not current or incomplete), BFR has the right to suspend or terminate Your access and activity, and refuse any and all current or future use of this Site.

12. You are specifically prohibited from any use of this Site, and You agree not to use or permit others to use this Site, for any of the following: (a) disclose to, or share with, the assigned confirmation numbers and/or passwords with any unauthorized third parties or using the assigned confirmation numbers and/or passwords for any unauthorized purpose; (b) upload, post, emailing or otherwise transmitting any Information, Content, or proprietary rights that You do not have a right to transmit under any law or under contractual or fiduciary relationships; (c) violating any applicable local, state, national or international law, including, but not limited to, any regulations having the force of law; and, (d) using any robot, spider, intelligent agent, other automatic device, or manual process to search, monitor or copy this Site, or the Content without BFR's prior written permission, provided that generally available third party Web browsers such as Netscape Navigator® and Microsoft Internet Explorer® may be used without such permission.

    You acknowledge and agree that BFR may preserve Information and may also disclose Information if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the Terms; (c) respond to claims that any Information violates the rights of third parties; or (d) protect the rights, property, or personal safety of BFR's business, employees, Providers, affiliates, users, and/or the public.

14. This Site may contain links to third party and/or other BonaFide Realty-affiliated Sites not under its control or operation (the "Affiliates"). The links will let You leave this Site, and You access them at Your own risk. You acknowledge that BFR provides the Affiliates for Your convenience and information only. BFR does not endorse nor is responsible for any content, information, or other related materials found at any such Affiliates or any links contained within such Affiliates, whether or not BFR is affiliated with the owners of such Affiliates. Moreover, BFR does not control any use of content, information or other related material that You provide to, or is collected and/or tracked by, such Affiliates. Such use by Affiliates is governed by the terms of use statements and/or privacy policies of such Affiliates, not this Site, and as a result may differ from BFR. 18. (GOVERNING LAW AND JURISDICTION) BFR operates this Site (excluding Affiliates) from its offices within the States of New Jersey. It can be accessed from all 50 states, as well as from other countries around the world. As each of these places has laws that may differ from those of New Jersey, by accessing this Site, You agree that these Terms and Your use of the Site shall be governed in all respect by the internal substantive laws of the State of New Jersey, without regard to conflict of laws provisions and shall not be governed by the United Nations Convention on the International Sale of Goods. You further submit to exclusive jurisdiction and venue in the state and federal courts located in the State of New Jersey for all disputes, cases and controversies regarding this Site, Your use of this Site, and Your relationship with BFR. BFR makes no representation that materials on this Site are appropriate or available for use in other locations, and accessing them from territories where the Content is illegal is prohibited. 19. (INDEMNIFICATION) BFR reserves the right to report any wrongdoing, if and when BFR becomes aware of it, to any applicable government agencies. You agree to indemnify, defend and hold BFR and the Providers, BFR and their officers, directors, employees, affiliates, agents, licensors, and suppliers harmless from and against any and all claims, demands, actions, costs, liabilities, losses and damages of any kind (including attorneys' fees) resulting from Your use of this Site, Your breach of any provision of these Terms and/or any negligent acts, omissions or intentional wrongdoing by You. Any such indemnification shall be conditioned on BFR'S: (a) notifying You in writing of any such claim, demand, action, cost, liability, loss or threat of any thereof; (b) cooperating with You in the defense or settlement thereof; and (c) allowing You to control such defense or settlement. BFR shall be entitled to participate in such defense at its own cost and expense.

20. (OTHER) These Terms are for the benefit of BFR and the Providers, BFR and their officers, directors, employees, affiliates, agents, licensors, and suppliers. Each of these individuals or entities shall have the right to assert and enforce these Terms directly against You on its (or their own) behalf. BFR'S failure to act with respect to a breach by You or others does not waive BFR'S right to act with respect to subsequent or similar breaches. If any provision of these Terms is held to be invalid or unenforceable, such provision will be struck and the remaining provisions enforced. Headings are for reference purposes only.

21. HOMES.COM is one of the largest Internet real estate sites with hundreds of thousands of homes for sale and apartment rentals with photos, descriptions, and relocation services. The advertisers and publishers are not responsible or liable for misinformation, misprints, or other errors. All information provided is deemed reliable but is not guaranteed and should be independently verified. Properties subject to prior sale or rental.

22. "Lowest Price in Town Guaranteed" promotion not valid on sales or purchases prior to May 1, 2008.

    The provisions and conditions of these Terms, and each obligation referenced herein, represent the entire Agreement between BFR (including the Providers), BFR'S affiliated or related entities, and You, and supersede any prior agreements or understandings not incorporated herein. In the event that any inconsistencies exist between these Terms and any future published terms of use or understanding, the last published Terms shall prevail.

    BFR RESERVES ANY RIGHTS NOT EXPRESSLY GRANTED OR STATED IN THESE TERMS AND RESERVES THE RIGHT TO UPDATE THESE TERMS WITHOUT NOTICE.
